Welcome to Le Lovinter Boutique. These Terms of Service (“Terms”) apply to your use of our website, online store, products, services and related features (collectively, the “Services”).

Le Lovinter Boutique operates the store and website. Our online store is powered by Shopify.

By accessing or using our Services, you agree to these Terms. If you do not agree with these Terms, please do not use our Services.

These Terms apply together with our Refund & Exchange Policy and Privacy Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other law that cannot legally be excluded, restricted or modified.


1. Access and Accounts

You may browse our website without creating an account. Certain features or purchases may require you to provide information such as your name, email address, billing information and shipping information.

You agree to provide information that is accurate, current and complete and to update it where reasonably necessary.

When you submit an order through our website, you are requesting to purchase the products listed in your order.

An order is accepted when we confirm acceptance of your order or otherwise indicate that the order has been accepted.

We may decline or cancel an order where reasonably necessary, including where:

  • A product is unavailable;
  • There is an obvious pricing or listing error;
  • We reasonably suspect fraud or unauthorised activity;
  • We are unable to fulfil the order;
  • There has been an error in the order information; or
  • Cancellation is otherwise reasonably necessary in the circumstances.

If we cancel an order after payment has been received, we will provide an appropriate refund.

Where possible, we will contact you using the details provided with your order.

Once an order has been accepted, cancellation requests may not always be possible. If you wish to cancel an order, please contact us as soon as possible.

Your rights under the Australian Consumer Law are not affected by this section.


4. Prices and Billing

Unless otherwise stated, prices displayed on our Australian online store are in Australian dollars (AUD) and include GST where applicable.

Any applicable delivery charges or other additional charges will be displayed before you complete your purchase.

We may change prices for future purchases at any time. The price applicable to your order will generally be the price displayed when you place the order, unless we need to correct an obvious pricing error.

Promotional prices, discounts and special offers may be subject to additional terms. Where there is a conflict between promotion-specific terms and these Terms, the promotion-specific terms will apply to that promotion to the extent permitted by law.

You agree to provide accurate and current payment and billing information.

You confirm that you are authorised to use the payment method provided for your purchase.

Payment processing may be carried out by Shopify or third-party payment providers. Their own terms and privacy policies may also apply to payment processing.


5. Shipping and Delivery

We will arrange delivery using the delivery method selected or otherwise communicated at checkout.

Delivery times provided on our website are estimates unless we expressly agree to a specific delivery date.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, natural disasters, customs processing, strikes or other events beyond our reasonable control.

If your order is significantly delayed, does not arrive, or is damaged during delivery, please contact us so that we can investigate the issue and assist you.

We will not use this section to exclude or limit any rights you may have under the Australian Consumer Law.

Our change-of-mind policy does not limit your rights under the Australian Consumer Law.

If goods do not meet a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and whether the failure is major or minor.

Where there is a major failure, you may generally be entitled to choose between a refund and replacement.

Nothing in these Terms or our Refund & Exchange Policy excludes, restricts or modifies rights that cannot legally be excluded under the Australian Consumer Law.

Our website and Services contain material including, but not limited to:

  • Designs;

Your purchase of products from Le Lovinter Boutique is a transaction between you and Le Lovinter Boutique.

Shopify is not the seller of the products offered by Le Lovinter Boutique and is not responsible for our products, refunds, exchanges, shipping obligations or other responsibilities as the seller.

You may not transfer your rights or obligations under these Terms where doing so would breach these Terms or applicable law.

Changes will generally apply from the effective date stated in the updated Terms and will not retrospectively change rights or obligations arising from orders that have already been accepted, unless otherwise required or permitted by law.
